A congressional study and a national consumer advocacy group found at the time that the health care industry had spent millions of dollars exaggerating the malpractice crisis in Nevada and elsewhere in the country. Doctors overall weren’t actually leaving Nevada at a high rate.

But the hard-hitting television campaign of five years ago, produced by influential Republican strategist Sig Rogich, helped persuade voters to overwhelmingly approve an industry-backed ballot initiative imposing a $350,000 cap on malpractice damages for pain and suffering.

The summer sun is almost upon the North Carolina and Virginia coast and so is bathing suit season. Many of those battling with obesity and trying to get slimmer have also opted for gastric bypass surgery, also known as stomach stapling, when they have exhausted all other options. Gastric bypass is a procedure where the stomach size may be reduced by over 90%.

Success with gastric bypass surgery results in the loss of weight and requires following a healthy diet regime. However, for some, gastric bypass surgery results in major medical problems or even death. The problem has been so widespread that these problems have been commonly referred to by many nurses as a “gastric bypass gone bad” and have resulted in numerous medical malpractice lawsuits.

When the desire to lose the excess weight is so passionate that a major surgery is chosen the desired result is to live the new life with a new healthy body. When something goes wrong that result is not only lost physically bad, but emotionally bad.

A bill that would make it harder to win a medical malpractice lawsuit against an emergency room physician garnered widespread support as it passed in the Utah Senate this morning. Bill co-sponsor Senator John Valentine said the stakeholders interested in the bill came to the table and hashed out some compromises last week, then created an amended, substitute bill.

“This is a consensus bill. Senator Bell, myself, Senator Knudson, members of the trial lawyers, members of the medical community all sat in a room last Friday, and for nearly two hours, hammered out the respective positions that you see in the substitute,” he said.
