Bill proposes changes to state personal injury law
Some sections of House Bill 1603 amend just a few phrases of law; some sections would create whole new sections of law several pages long. But each section of the bill carried by state Rep. Daniel Sullivan, R-Tulsa, as the main tort reform measure of the session, makes significant changes to Oklahoma law dealing with personal injury.
Section 23 makes several changes related to class-action lawsuits. First, if a court order certifying a class is appealed, the appeals court will review the determination de novo, as if the matter were being considered for the first time.
The section would change the law to require members of a class-action lawsuit to opt in to participate; current law automatically includes all members except those who opt out of the lawsuit. Judgment in class-action cases would include only those members who have “advised the court by the specified date that they desire to be included in the class.” The bill would change the wording of the law to require notification to all “potential” members of a class.
